10. Data Protection and Privacy

The use of personal data (also in the online shops) is conducted on the basis of the ‘Data Protection and Privacy Declaration’ shown below, as indicated by the sales staff in over-counter sales, and which is also especially published in the website shops on the websites of the Corporation under the title ‘Data Protection’.
We thank you for your trust. Protecting your personal space and privacy is very important to us, which is why we strictly observe the legal regulations while raising, processing and using your personal data.
A few notes regarding carefully protecting your privacy and complete confidentiality when using your personal data:

is responsible for the raising, processing and use of your personal data.

10.1 Anonymous Data Raising (via the online shops)

In principle, you may visit our website without disclosing who you are. In this case, we only save access data without personal references, such as the name of your Internet service provider, the website from which you are visiting us and the name of the file requested. This information is only used for statistical purposes and serves to improve our offers. You remain anonymous as an individual user for this.

10.2 The Raising, Processing and Use of Personal Data

Personal data is information about your identity, such as: first name, last name, firm’s name, postal address (street address, place, postcode, country), e-mail address, website address, value-added tax identification number (when existent). Personal data is only raised when you disclose this voluntarily for concluding a contract of purchase and sale, processing a purchase order and any possible subsequent warranty, for the opening of a Customer account, for placing an order (e.g. ordering goods or a catalogue, etc.) (by telephone, fax- or e-mail , by post or via website shop order), or when registering for our e-mail newsletter. We also use personal data provided by you for the purposes of processing orders and dealing with return queries (by telephone, fax or e-mail), for responding to your queries (by telephone, fax or e-mail), an also for advertising purposes (e.g. for the distribution of advertising printed matter concerning our products, by post or e-mail), and in addition for the raising of personal data, as well as for the storage of such data until express revocation is required by Customers. You may therefore withdraw any consent granted for the collection, processing and use of your personal data at any time.
Your e-mail address will be used exclusively for information and the advertising purposes of your own goods and services after the conclusion of the contract. The e-mail address can also be used for distributing the newsletter, when the Customer has subscribed for it. You may however cancel the newsletter at any time through the link provided in the newsletter or by appropriate notification. After successful cancellation, your e-mail address will be deleted immediately from the distribution list.

10.3 Disclosure of Personal Data

We do not disclose your data, including your address and e-mail address to third parties. Excluded from this are our service partners, such as, e.g. haulage companies that require certain data (name, postal address, possibly telephone number and e-mail address) for delivering an order. The extent of the disclosed data is always limited to the absolute minimum. The disclosure of personal data may only be used by our service providers for conducting their assignments.

10.4 Cookies (as used on online shop websites)

Among other things our online shop uses, e.g. so-called ‘cookies’ which serve to make our website more user-friendly, effective and secure – for example when it comes to speeding up navigation on our platform. Also, cookies enable us to measure the possible frequency of page views and general navigation. By using our shop, you declare to be in agreement that we set cookies. We point out that some of these cookies are transferred from our server to your system, whereby it is usually about so-called ‘session cookies’. ‘Session cookies’, therefore, distinguish themselves by being automatically deleted from your hard drive. The cookies remain on your computer after registering and opening a Customer account beyond the termination of a browser session and thus enable us to recognise your computer at your next visit (so-called permanent cookies). You may refuse accepting cookies in your browser settings. Please refer to the instructions of your browser manufacturer for how this works individually, for which we note, however, that this may lead to functional limitations of our online shop.

10.5 The Use of Google Analytics (as used on online shop websites)

This website uses Google Analytics, a web analysis service of Google Inc. (‘Google’). Google Analytics uses so-called ‘cookies’, which are text files that are placed on your computer and that enable an analysis of your usage of the website. The information generated about your usage of this website (including your ISP address) is transferred to a Google server in the U.S.A. and stored there. We point out that this website uses Google Analytics with the extension “_anonymizelP()”and, therefore, ISP addresses, but abbreviated, are further processed, in order to exclude direct links to individuals. Google will use the information to evaluate your usage of the website for preparing reports regarding the website activities for the website provider and providing further services linked to website usage and use of the Internet. Google may also possibly transmit this information to third parties, as far as this is legally required or as far as third parties process these data on behalf of Google. Google will not under any circumstances connect your ISP address to other Google data. You may prevent the installation of cookies by an appropriate setting of your browser software; we point out, however that in that case you may possibly not be able to fully exploit all the functions of this website. 10.6 Repeating Consent Declarations

You have expressly given us the following consent and we have recorded your consent. We are obliged by law to have the content of your consent available for viewing at any time. You may revoke your consent at any time effective from then onward.

a.) Consent to advertising campaigns (post or email advertising)

I am in agreement that my post and email addresses may be used for advertising purposes. I may revoke this consent at any time by email to: office@witasek.com with the remark ‘Cancel Advertising’ in the subject header, or by calling: 0043 4276 3230.

b.) Registration

I agree that, when opening a Customer user account, as well as when placing an order (for ordering goods or a catalogue) (by telephone, fax, e-mail or by post or via website online shopping), my used data (first name, last name, postal address, email address, website address, value-added tax identification number, ISP address or password) may be stored in a Customer database for the purpose of the faster processing of future orders. I may revoke this consent at any time by contacting the Seller, with effect for the future, by telephone or e-mail, and require the erasure of the Customer user account in the system of the Seller, but subject always to the statutory archiving time periods imposed upon the Seller.

c.) Use of Cookies (as used on online shop websites)

II agree that as long as my Customer user account remains in good standing, my e-mail address and my password may be saved in cookies beyond the end of the browser session for the purpose of faster completion of future orders and may be accessed during my next visit. I may revoke this consent at any time with the Seller effective from then onwards, whilst I refuse to accept cookies in my browser settings or by telephone or e-mail message and arrange for the cancellation of the Customer user account.

10.7 The Use of External Links (as used on online shop websites)

In so far as that we refer or link from our Internet offer to the websites of third parties, we cannot accept any responsibility and liability for the accuracy or completeness of the content and data security of these websites. Because we do not have any influence on the actual and future design of and compliance with privacy laws of the linked pages, as well as compliance with privacy regulations by third parties, we are not responsible for the contents of the linked pages and also do not appropriate their contents. You should, therefore, check the respective privacy statements separately. Our privacy statement does not apply there.

10.8 The Right to Information

You are entitled to free information regarding your saved data, as well as the right of authorisation, blocking or – conditional on legal storage deadlines – deletion of these data.
